I understand the risks of training in the martial arts taught at this club and have carried out my own risk assessment. Injuries in full contact martial arts are commonplace and I understand that managing and avoiding this is my responsibility.
I understand that full contact training might expose me to viruses and illness and I opt in and accept these risks to myself and my household and social group.
I confirm that I will not train when I am feeling unwell or under the influence of alcohol or drugs.
I understand that if I have any pre-existing injuries or health issues then I must make the club and instructors aware of them. I also understand that any prior conditions may be made worse and I will adjust my training and attitude accordingly.
I enter into the training at this club knowing that serious injury or even death are a possibility and release all instructors and employees of the Club from any responsibility thereof.
I confirm that I am voluntarily participating in activities at my own risk, having considered and understood all inherent dangers. I accept full responsibility for any injury or loss sustained, except where directly caused by the negligence of the Companies.
a) I represent and warrant that I have NO physical infirmities or pre-existing Injures; I am not under treatment for any other physical infirmity or chronic ailment or injury of any nature, and have never been treated for or diagnosed to have any of the following: Cardiac or pulmonary conditions or diseases, diabetes, fainting spells or convulsions, nervous or mental disorders, kidney or related diseases, high or low blood pressures, or any other disability which might in any way affect my ability to participate in Brazilian Jiu-Jitsu, Muay Thai, Eskrima, Wrestling, Karate, Judo, Boxing, MMA, weight training, Self Defence, physical exercise or all similar and related activities.
b) I am not taking any medications of any kind which might in any way affect my ability to participate in Brazilian Jiu-Jitsu, Muay Thai, Judo, Boxing, Wrestling, Karate, MMA, Eskrima or all similar and related activities.
c) I am not under the influence of any alcohol or drugs.
d) I am not pregnant nor do I suspect that I am pregnant.
e) I hereby certify that the personal information I have given above is true and accurate.
f) members must promptly inform the Club of any changes to their health or physical condition that could affect their ability to train safely.
IMPORTANT – PLEASE READ CAREFULLY BEFORE SIGNING
Martial arts are physically demanding and carry an inherent risk of injury. This agreement sets out the terms on which you participate in activities at Maidenhead Martial Arts Ltd and Qube Fitness Ltd (“the Companies”). By signing, you confirm you understand and accept these terms.
I understand that training in martial arts, including but not limited to Brazilian Jiu-Jitsu, Muay Thai, Karate, Judo, Boxing, Wrestling, MMA, Eskrima, weight training, self-defence, and other similar activities (“Martial Arts Training”), involves inherent risks.
These risks include, but are not limited to:
Strains, sprains, muscle and tendon injuries
Broken bones and joint injuries
Restriction of air or blood flow during grappling
Bruising, cuts, and impacts from lawful contact
In rare cases, serious injury or death
I understand that martial arts sparring and training may involve lawful strikes, throws, chokes, and joint locks, and that failure to tap or disengage when required may result in injury for which I am solely responsible.
I understand that these risks cannot be completely eliminated without changing the nature of the activity, and I participate voluntarily. I confirm that I have not relied on any oral or written representations, promises, or assurances about safety, results, or any other matter except as expressly set out in this agreement.
I confirm that:
a) I am in good physical health and do not have any medical condition that would make participation unsafe.
b) I am not under the influence of alcohol, illegal drugs, or any medication that could impair my ability to train safely.
c) If I have any pre-existing injuries or health concerns, I will inform the Club before training and take appropriate measures to train safely.
d) I will not attend training if I feel unwell, have symptoms of illness, or may be carrying an infectious condition.
e) Members must report any injury sustained during training to an instructor immediately and record it in the Club’s accident log.
Nothing in this agreement excludes or limits the Companies’ liability for death or personal injury caused by negligence, or for any other matter which cannot be excluded under UK law.
Subject to the above, I agree that:
I am responsible for my own safety and conduct during training.
The Companies are not liable for any loss, damage, or injury sustained except where caused by negligence or breach of statutory duty.
I will follow all safety instructions and club rules to minimise risk.
I agree to indemnify and hold harmless the Companies, their instructors, officers, directors, employees, contractors, and agents (“Covered Parties”) from and against any and all claims, demands, causes of action, losses, damages, liabilities, costs, and expenses (including reasonable legal fees, on a full indemnity basis) arising from:
My breach of this agreement or the Club’s rules;
My actions or omissions during training or while on Club premises;
Any injury or damage I cause to another person or property; or
Any claim brought by a third party as a result of my participation in activities.
This clause does not limit any rights I may have under UK law in respect of death or personal injury caused by the negligence of the Covered Parties.
I agree that any claim, dispute, or legal action arising from my participation in activities will be made only against Maidenhead Martial Arts Ltd or Qube Fitness Ltd and not against any individual officers, directors, employees, contractors, or agents of those companies in their personal capacity.
Where a member arranges personal one-to-one coaching sessions directly with an individual coach who also teaches at Maidenhead Martial Arts, that arrangement is solely between the member and the individual coach. The session is not provided by, or on behalf of, Maidenhead Martial Arts Ltd or Qube Fitness Ltd.
Any claim, dispute, or legal action in relation to such private coaching will be made only against the individual coach and not against Maidenhead Martial Arts Ltd or Qube Fitness Ltd.
I understand and agree that the Companies may take photographs, video, or audio recordings during classes, events, or activities, which may include my image or (if applicable) the image of my child. These may be used for marketing, promotional, or educational purposes, in print or online, without further payment or consent.
If I do not wish to be included, I will notify the Club in writing before attending. The Club collects and stores personal data for the purposes of administering membership, ensuring safety, and communicating with members. Data will be stored securely and handled in accordance with UK data protection laws (including the UK GDPR). Members may request access to, correction of, or deletion of their personal data at any time. A full privacy notice is available on request.
Members may not photograph or film any class, participant, or instructor without prior written consent from the Club.
a) Minimum Term – All memberships have a minimum commitment of three (3) full calendar months.
b) Cancellation by Member – After the minimum term, cancellation requires at least seven (7) days’ written notice before the next billing date. Members must send an email to the Club to confirm cancellation. Stopping attendance without notifying the Club does not count as cancellation.
c) Direct Debit Cancellation – It is the member’s responsibility to cancel their Direct Debit with their bank or payment provider after giving notice.
d) Rejoining Fee & Refunds – Former members rejoining the Club may be charged a rejoining fee (currently £40). All membership fees and event payments are non-refundable except where required by law.
e) Belt and Certificate Fees – For children’s classes, the Club may charge a belt and certificate fee of up to £10 for promotions. Stripes are provided free of charge.
f) Events & Fees – For members enrolled in Brazilian Jiu-Jitsu, an additional fee (currently £45) will be automatically added to your account once per year to cover participation in the annual summer barbecue and grading event. The Companies reserve the right to vary this fee with reasonable notice.
g) Club Closures – The Club may close on public holidays, during electricity or utility supply interruptions, or for up to two weeks over the Christmas/New Year period without any reduction in membership fees.
h) Suspension for Non-Payment – The Club may suspend access to classes if fees are overdue. Suspension does not remove the obligation to pay for the minimum term.
i) Late Payment Fees – The Club may charge a reasonable late payment fee for overdue amounts.
j) Payment Processing – I understand that my membership fees may be collected by a third-party company or payment processor acting on behalf of Maidenhead Martial Arts Ltd or Qube Fitness Ltd. This does not affect the fact that my membership, participation, and all related services are provided by Maidenhead Martial Arts Ltd and/or Qube Fitness Ltd, and all terms of this agreement, including waivers and liability limitations, apply in full regardless of the payment recipient.
k) Deemed Acceptance – If I am provided with this agreement by email or other electronic means and I continue to attend classes, events, or use the facilities of Maidenhead Martial Arts Ltd or Qube Fitness Ltd without signing, I will be deemed to have accepted and agreed to all terms and conditions contained in this agreement in full.
l) Price Changes – The Companies reserve the right to change membership fees and other charges from time to time. The current prices will always be displayed on the Club’s website. Any change to membership fees will take effect from the next billing date that falls at least 14 days after the new prices are published on the website. Continued attendance after that date will be deemed acceptance of the new price.
Nothing in these terms affects a member’s statutory rights under the Consumer Rights Act 2015.
Follow instructor directions at all times.
Train respectfully and with control to avoid injury.
Wear appropriate clean training attire.
No training while ill, injured (without clearance), or under the influence of alcohol or drugs.
All Brazilian Jiu-Jitsu members must observe the Club’s hygiene rules and the Club’s banned moves policy, as displayed on the noticeboard.
Parents/guardians remain responsible for supervising children under 10 before and after class, including in waiting areas.
Any breach of safety or conduct rules may result in suspension or termination of membership.
Members agree to raise any complaints directly with the Club first and not to post reviews or public statements that are false, misleading, or unfairly damaging to the Club’s reputation.
The Club’s published safety rules, hygiene policy, and banned moves list form part of this agreement and are binding on all members.
The Club reserves the right to change class times, formats, instructors, or locations at its discretion, with reasonable notice where possible.
The Club will not be liable for failure to provide classes or facilities due to events beyond its reasonable control, including but not limited to severe weather, natural disasters, government restrictions, pandemics, electricity or utility supply interruptions, or other infrastructure failures.
In such cases, classes may be cancelled without any reduction in membership fees.
If the participant is under 18 years old, this agreement must be signed by their parent or legal guardian, who accepts all terms on behalf of the minor and confirms they have explained the risks involved.
All members who pay their subscription fees for classes operated by Maidenhead Martial Arts Ltd or Qube Fitness Ltd are covered under Maidenhead Martial Arts Ltd’s public liability insurance, except when participating in any third-party classes run by independent instructors renting the facilities (including but not limited to wrestling), which are not covered under this insurance.
Qube Fitness Ltd does not hold separate public liability insurance for these activities. Members are responsible for arranging their own personal accident or health insurance if desired.. Members are responsible for arranging their own personal accident or health insurance if desired.
Martial arts progress depends on individual effort, attendance, and ability. The Club does not guarantee specific results or outcomes.
In the event of injury or illness, I consent to the Club arranging or providing emergency medical treatment as deemed necessary, and I agree to be responsible for any associated costs.
This document forms the entire agreement between the participant (or their parent/guardian) and the Companies, superseding all prior discussions or understandings. If any part of this agreement is found to be invalid or unenforceable, the remainder will still apply. This agreement is governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Any legal action must be brought in the courts located in England, and I irrevocably submit to their jurisdiction.
From time to time, independent instructors may rent facilities at Maidenhead Martial Arts to run their own classes, including but not limited to wrestling. These classes are not operated by, or on behalf of, Maidenhead Martial Arts Ltd or Qube Fitness Ltd. Participation in such classes is solely between the participant and the independent instructor. The Companies have no responsibility or liability whatsoever for any loss, damage, injury, or death arising from participation in these third-party classes. Maidenhead Martial Arts Ltd’s public liability insurance does not provide cover for these third-party classes, and Qube Fitness Ltd holds no public liability insurance for such activities. The Companies have no responsibility or liability whatsoever for any loss, damage, injury, or death arising from participation in these third-party classes.
Any dispute arising from this agreement or the Member’s participation in activities must first be raised in writing with the Companies and addressed through the Companies’ internal complaints procedure.
If the dispute is not resolved, the parties agree to attempt resolution through mediation or arbitration administered by CEDR (Centre for Effective Dispute Resolution) before commencing court proceedings.
The costs of any mediation or arbitration shall be borne equally by the parties unless the mediator or arbitrator determines otherwise.
Nothing in this clause prevents either party from seeking urgent relief through the courts where necessary.
Nothing in this agreement limits or excludes any rights I may have under UK law in respect of death or personal injury caused by the negligence of the Companies or their representatives.
I acknowledge that my contract for participation in activities and use of the facilities is solely with Maidenhead Martial Arts Ltd and/or Qube Fitness Ltd (“the Companies”) as corporate entities. The Companies are the sole providers of all services, and all instructors, coaches, directors, officers, employees, contractors, agents, or volunteers act only in their capacity as representatives of the Companies and not in any personal capacity.
To the fullest extent permitted by law, I agree that:
a) I will not make any claim, commence any proceedings, or seek any remedy against any director, shareholder, officer, employee, agent, coach, contractor, volunteer, or representative of the Companies in their personal capacity, whether in negligence, breach of statutory duty, or otherwise, in connection with my participation in activities or my use of the facilities.
b) I waive any right to name such individuals as defendants or co-defendants in any legal proceedings relating to my participation, except where such exclusion is prohibited by law.
c) If I bring any such claim in breach of this clause, I will indemnify that individual and the Companies for all losses, costs, and expenses (including legal fees on a full indemnity basis) incurred as a result.
d) I acknowledge that the Companies are private limited companies registered in England and Wales, and I will not seek to disregard or “pierce” their separate legal personality.
This clause applies to any dispute, including those involving health and safety matters, premises control, or event organisation, and any such dispute shall be treated as a dispute with the Companies only.
Failure by the Companies to enforce any term of this agreement shall not be construed as a waiver of any rights, and no waiver shall be binding unless in writing and signed by a Company Director.
I waive any right for my heirs, executors, administrators, or assigns to make a claim against the Companies for any injury, loss, or death arising from my participation, except where prohibited by law.
For members joining online or via app.this agreement may be signed electronically, and an electronic signature or recorded online acceptance is binding as an original. All waivers, indemnities, and limitations of liability in this agreement survive the termination or cancellation of membership.
If any provision of this agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
